1. Acceptance of Terms

By accessing or using The Collection, you agree to be bound by these Terms of Service.

2. Eligibility

The Service is available by invitation only. You must be at least 18 years old.

3. User Content

You retain ownership of all content you upload. By uploading, you grant The Collection a limited license to display your content within the platform.

4. Acceptable Use

You agree not to misuse the Service, including uploading content you do not have rights to.

5. Intellectual Property & Prohibited Use

All content on The Collection, including but not limited to artwork images, descriptions, articles, editorial content, user profiles, and collection data, is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from The Collection or its associated applications for any purpose without express written permission from the content owner or The Collection.

You may not use any automated means, including but not limited to web scrapers, crawlers, bots, spiders, data mining tools, or artificial intelligence and machine learning systems, to access, collect, harvest, index, or train on any content from The Collection. This includes but is not limited to using content to train, fine tune, or otherwise develop any machine learning model, large language model (LLM), generative AI system, or similar technology. Unauthorized scraping, data extraction, or AI training on our content constitutes a violation of these Terms and may result in immediate termination of access and legal action.

6. SMS and Text Message Program

The Collection offers an optional SMS text message program for art auctions. You may provide a mobile phone number and opt in by checking a box when you place a bid on, or choose to watch, an auction on collctn.art. Opting in is optional and is never a condition of any purchase. If you opt in, we send transactional alerts about that auction only: when you are outbid, when the auction is about to close, and if you win. Message frequency varies with auction activity, and message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for assistance. We do not sell or share your mobile number or SMS opt-in with any third party or affiliate for marketing purposes. See our Privacy Policy for details.
